Trata do monitoramento do empregado feito pelo empregador, em especial, ao uso do correio eletrônico (e-mail) e a filmagem por câmeras de monitoramento localizadas no ambiente de trabalho, que podem ser aplicadas desde que se cumpram determinados requisitos e não existam outras maneiras de coibir possíveis prejuízos que podem ser causados na empresa.
The emergence of new technologies has developed in a way to pose important challenges to the factic and legal worlds. New values appear or are modified, partly influenced by the technological development. A wide range of rights is challenged as, for example, personal rights such as privacy, property rights, hiring forms, the several forms of responsibility, among others. In this context, very important issues are raised to be dealt with by the Labor Court concerning the use of electronic appliances by the employer in the work environment to monitor employees, mainly the use of e-mail and cameras in the labor environment, which may be used as long as some requirements are met and there are no other ways to prevent possible damage to be caused in the company.
