Abstract

Demonstra que a ciência penal liberal de inspiração iluminista não mais atende aos anseios da sociedade que vive num mundo globalizado, de avanços tecnológicos. Houve a ruptura do paradigma de proteção de bens jurídicos individuais para a tutela difusa, onde bens jurídicos são necessários para a vida em sociedade. Isso não quer dizer que bens individuais não merecem tutela, no entanto não exclusivamente. Enfoca as transformações do direito penal tradicional.ABSTRACT: In the bulge of the present article, it will be looked to demonstrate that the liberal criminal science of iluminista inspiration more does not take care of to the yearnings of the society that lives in a globalizado world, of technological advances. It had the rupture of the paradigm of protection of individual legal goods for the diffuse guardianship, where legal goods are necessary for the life in society. This does not want to say that individual goods do not deserve guardianship, however not exclusively. To focus the transformations of the traditional criminal law the work was divided in three parts: At a first moment it has the explicitação of the traditional right, after the some conceptions on legally protected interest, and finally the characteristics of the modern criminal law.
