“O direito à informação e o direito à imagem são bens protegidos pelo ordenamento jurídico brasileiro. São direitos fundamentais pertencentes à pessoa humana. Existem e convivem harmonicamente. Mas, diante de situações concretas, podem entrar em colisão entre si, o que leva à necessidade de proteger um em sacrifício do outro. Como critério solucionador da colisão de direitos fundamentais, deve-se aplicar o princípio da proporcionalidade: faz-se uma ponderação de valores e protege-se o bem jurídico que, no caso concreto, for mais importante. Mas, ambos os bens - informação e imagem -, permanecem íntegros no sistema jurídico e por este protegidos”.; “The right to information and the right to image are rights protected by the Brazilian Juridical Order. They are fundamental rights belonging to the human person: they exist and live together harmoniously. But, due to concrete situations, they can enter in collision amongst themselves, what makes it necessary to protect one in sacrifice to the other.
