O presente artigo trata do princípio do juiz natural e do princípio do duplo grau de jurisdição em consonância com os direitos fundamentais. O texto focará a relação do devido processo penal como um processo de partes e a garantia do juiz natural. Será analisado o duplo grau no direito comparado e na Constituição de 1988. The present article takes up the natural judge and double jurisdiction principles in relation to the fundamental rights. The text will focus on the relation between the due process of law in criminal litigation and the natural judge guarantee. It will be made an analysis of the double jurisdiction principle in comparative law and in the 1988 Constitution.
