Resumo: | O presente artigo se propõe a configurar o imaginário
jurídico da conciliação sob a perspectiva de gênero, relacionando duas
grandes categorias de análise: as formas objetivas de intervenção do
Estado a partir das instituições formais do Direito e os imaginários
que permeiam os discursos dos operadores do Direito e dos sujeitos
sociais implicados nas práticas jurídicas do Juizado Especial Criminal.A
conciliação, como prática utilizada pelos Juizados Especiais Criminais
está determinada normativamente pela Lei 9.099/95 cujo critério
procedimental baseia-se numa prestação jurisdicional célere,
privilegiando a oralidade, simplicidade e economia processual. A
investigação empírica centraliza-se num recorte específico, em processos
de ação penal condicionada interpostos num período de (07) sete meses
(janeiro a julho) de 1998, no 1º Juizado Especial da Comarca de
Aracaju/ Estado de Sergipe. A conciliação se realiza como uma ação
discursiva estruturada estrategicamente pela administração da Justiça
com finalidade desburocratizadora, repercutindo na problemática de
gênero na medida em que os pequenos delitos se constituem em
grandes ofensas sofridas na esfera privada, no âmbito da violência
doméstica, ressurgindo na esfera pública sob a estrutura patriarcal do
Direito Penal brasileiro. This article intends to examine the judicial frame of thought of conciliation from a perspective of gender issues by relating two broad categories of analysis: 1) the objective forms of the State’s intervention via formal legal institutions, and 2) the perspectives that permeate the discourses of legal operators and the social subjects involved in the judicial practices of the special criminal court system. Law 9.099/95 normatively defines conciliation as a practice used in the Special Criminal Courts whose procedural criteria is based on rapid jurisdictional installment, favoring oral communication, simplicity, and procedural economy. As a technique for conflict resolution, conciliation has the objective of reaching an agreement between the author of the crime and the victim on the crime in question, thereby permitting the resolution of the litigation in the penal sphere.The empirical study is centered on the specific context of criminal suits during a period of seven months (January-July, 1998), in the first Juizado Especial da Comarca de Aracaju / Estado de Sergipe (Special Court of the Aracaju District / State of Sergipe).This dissertation has the intention of deepening the sociojudicial experience of criminal conciliation by rethinking the conciliation practice inserted within the socio-judicial frame of thought. These conceptions, as expressed by the judicial discourse in the legal process, are represented in the forms of sentences or the set of habits, ways of thinking and acting as legal operators and users of the Special Criminal Justice courts. They serve to identify, analyze, and describe the multiple meanings prevailing in the construction of the judicial frame of thought of conciliation.Conciliation is carried out through a discursive action that is strategically structured by the administration of justice in order to diminish the bureaucracy of the judicial system. It reflects gender issues in that minor crimes are constituted as major offenses suffered in the private sphere of domestic violence, extending to the public sphere within the patriarchal structure of the Brazilian penal system. |
