Casamento e concubinato : um estudo crítico = Marriage and concubinage : a critical study

Abstract

“A Constituição da República Federativa do Brasil proclamou que a família é a base da sociedade e tem especial proteção do Estado. Estabeleceu, também, que essa proteção é devida tanto às famílias originadas através do casamento como da união estável (concubinato). A partir daí, a união estável foi expressamente reconhecida na Lei Maior, cabendo ao legislador ordinário a tarefa de regulamentar o preceito constitucional. Duas leis foram promulgadas com esse fim, a Lei nº 8791/94 e Lei nº 9278/96. Este estudo objetiva uma análise crítica sobre as duas citadas leis, bem como a comparação entre os efeitos jurídicos da união estável e a do casamento.”

“The Brazilian Federal Republic Constitution ruled that the family is the basis of society and has a special protection of the State. It also establishes that this protection is to families formed by marriage as well as to those steady union (concubinage). Based on these statements, the steady union was definitely recognized as commandment of the Major Law, being the ordinary legislator assigned the task of regulating the constitutional precept. Two laws were promulgated with this purpose, law 8791/94 and law 9278/96. This study has the objective of doing a critical analisys on both laws mentioned above, as well as to draw a comparison on the juridical effects between the steady union and the marriage.”
