Abstract

Estuda o tema da estatalidade do Direito moderno. Visa abordar os aspectos epistemológicos e históricos que fizeram com que o Estado se tornasse a única instituição detentora da competência plena para dizer o Direito. Descreve e critica a teoria do positivismo jurídico.

This work has as its main objective the study of issues regarding the modern Law in the state. It aims at to approach epistemologies and historical the aspects that made the State become the only institution that withholds the full ability to state the law. Moreover, the tonic that it imprints to this analysis in screen is to describe and to criticize the theory that most incremented this model totally based in the power of the modern State, which is, the legal positivism.
