Demonstra a importância da efetividade do Processo Penal Cautelar para tornar as decisões úteis, elencando as características e os pressupostos encontrados na doutrina pesquisada, enfocando a prisão preventiva em sua natureza jurídica, seus pressupostos, as hipóteses previstas em lei que autorizam tal medida, o momento de sua decretação, quem pode requerer a custódia cautelar e quem é a autoridade competente para decretá-la, as proibições legais da imposição da medida, considerando tal instituto processual penal em face do princípio da presunção de inocência, disposto expressamente na Constituição Federal de 1988.; The present study develops around Preventive Criminal Process, demonstrating the importance of its effectiveness to take useful decisions. It shows the characteristics and the presuppositions found in the studied doctrine, focusing on the juridical nature of preventive custody and its presuppositions. It also analyzes the hypotheses foreseen in law that authorize such procedure, the moment of its enactment, who is entitled to request preventive custody and who is the competent authority to decree it. Finally, the legal prohibitions for the imposition of preventive custody are discussed, considering such criminal procedural institute in the face of the principle of presumption of innocence, disposed expressly in the Federal Constitution from 1988.
