Direito à proteção do menor = Right to the smallest's protection

Abstract

O Estatuto da Criança e do Adolescente, Lei nº 8.069, de 13 de julho de 1990, veio regular disposição contida na Constituição Federal, que atribuiu à família, à sociedade e ao Estado, o asseguramento de todos os direitos fundamentais das crianças e dos adolescentes. Esse Estatuto surgiu com o intuito de proteger os direitos dos menores, implantando Conselhos Nacionais, Estaduais e Municipais dos direitos da Criança e do Adolescente, bem como Fundos vinculados aos conselhos e, Conselhos Tutelares. Além disso, trata da tipificação penal e da capitulação de infrações administrativas das condutas violadoras de normas previstas no estatuto. Apesar da criação do Estatuto, ainda não se tem segurança que o amanhã será melhor ao menor.

“The Law 8.069, of July 13, 1990 (Statute of the Child and of the Adolescent), it came to regulate disposition contained in the Federal Constitution, that it attributed to the family, to the society and the State, the insurance of all the fundamental rights of the children and of the adolescents. This Statute appeared with the intention of protecting the rights of the smallest ones implanting Council National, State and Municipal of the Child's rights and of the Adolescent, of the Fund to him linked, of the Guardian Council, of the penal tipification and of the capitulation of the conducts violator's administrative infractions of some norms in him foreseen, in the search of the effectiveness of these, that for they provide public and social interest, they could not be included among the program norms, needing to find effectiveness and full application. Although the creation of the Statute, safety is not still had that the tomorrow will be better to the smallest. It is necessary to work a lot in function of these, because, they don't have enough laws that regulate this situation, they need to be applied”.
