Abstract

O instituto da coisa julgada, de origem romana, tem fundamento político, uma vez que visa garantir que os litígios submetidos à apreciação do Poder Judiciário se prolonguem definitivamente. A coisa julgada é uma qualidade que se une aos efeitos da sentença tornando-os imutáveis, conforme doutrina majoritária. No que se refere aos limites subjetivos da coisa julgada, esta não poderá beneficiar nem prejudicar terceiros. Os terceiros embora não atingidos pela coisa julgada devem submeter-se à eficácia da decisão. Dividem-se os terceiros em: juridicamente indiferentes e juridicamente interessados na relação decidida. A eficácia a que serão submetidos varia de acordo com a categoria “terceiros indiferentes e terceiros interessados“ a que fazem parte.

The institution of the Res judicata, originally from Rome, has political foundation. It intends to guarantee that the litigations submitted to the appreciation of the judiciary power will be definitively prolonged. The Res judicata is a quality that joins the effects of the sentence, turning them unalterable, according to majority doctrine. Concerning the subjective limits of the Res judicata, this can neither benefit nor harm third parties. Third parties, although not affected by the Res judicata, should submit themselves to the efficacy of the decision. Third parties are divided into juridically indifferent and juridically interested in the resolved relationship. The efficacy they will be submitted to varies according to the category - third indifferent and third interested parties ¿ they are inserted in.
